These terms apply to all users including CDL driver applicants and business inquiries. Please read them carefully before submitting any information through this platform.

1. About This Platform

This application platform is operated on behalf of California Overland, Ltd. ("we," "us," or "our"), a family-owned Minnesota trucking company providing refrigerated transportation solutions and tanker services. This platform provides DOT-compliant driver application funnels and recruiting communications for California Overland, Ltd.

2. SMS Terms & Conditions

SMS Opt-In Terms — A2P 10DLC Compliance

When you provide your phone number and check the SMS consent box(es) on any form on this platform, you agree to receive SMS messages as described below. Consent to receive SMS is not a condition of any purchase or service.

Non-Marketing / Transactional SMS: By opting in, you consent to receive SMS messages related to your driver application or inquiry, including application status updates, recruiter outreach, scheduling confirmations, and follow-up communications from California Overland, Ltd.

Marketing / Promotional SMS: By opting in to marketing messages, you consent to receive promotional communications including recruiting opportunities, company updates, special offers, and industry information from California Overland, Ltd.

Message frequency varies based on application activity and campaign enrollment. Standard message and data rates may apply depending on your mobile carrier plan.

To opt out of all SMS communications at any time, reply STOP to any message. To request help, reply HELP or contact us at [email protected] or (651) 927-5340.

All opt-in consent records are stored in our CRM system with timestamp and source documentation retained for a minimum of 4 years in compliance with TCPA recordkeeping requirements.

3. Application Data & Transmission

Information submitted through application forms on this platform is transmitted to California Overland, Ltd. for driver recruitment and hiring evaluation. By submitting an application, you authorize the transmission, storage, and processing of your application data in accordance with our Privacy Policy.

California Overland, Ltd. is solely responsible for data handling, retention, and compliance with applicable employment and privacy laws.

4. Acceptable Use

You agree to use this platform only for lawful purposes. You may not:

  • Submit false, misleading, or fraudulent application or contact information
  • Attempt to access, modify, reverse engineer, or disrupt the platform or its underlying systems
  • Use the platform to collect information about other users without authorization
  • Upload or transmit malicious code, viruses, or any harmful content
  • Reproduce, distribute, scrape, or create derivative works from platform content without prior written permission
  • Use the platform in any way that violates applicable federal, state, or local law

5. Intellectual Property

All platform code, design, copy, and content is the property of California Overland, Ltd. and its service providers, unless otherwise noted. The California Overland name, logo, and brand identity are proprietary. No content from this platform may be reproduced, distributed, or used commercially without prior written consent from California Overland, Ltd.

6. Hiring Decisions & Disclaimer

This platform provides application infrastructure and recruiting automation tools only. California Overland, Ltd. is solely responsible for all hiring practices, decisions, compliance with the Fair Credit Reporting Act (FCRA), Equal Employment Opportunity (EEO) laws, and all other applicable employment regulations.

7. DOT & FMCSA Compliance

Application templates are designed to include fields required under 49 CFR Part 391. However, we make no warranty that our templates constitute legal advice or that they will satisfy every regulatory requirement. California Overland, Ltd. is responsible for reviewing applications for compliance with current FMCSA regulations and for maintaining required driver qualification files.

8. Disclaimer of Warranties

This platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Limitation of Liability

To the maximum extent permitted by applicable law, California Overland, Ltd. and its service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use this platform, including but not limited to loss of data, lost profits, or business interruption. Our total aggregate liability for any claim arising from use of the platform shall not exceed $100.

10. Indemnification

You agree to indemnify, defend, and hold harmless California Overland, Ltd., its officers, directors, employees, contractors, and service providers from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the platform, your violation of these Terms, your submission of false or fraudulent information, or your violation of any third-party rights.

11. Privacy Policy

Your use of this platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using this platform, you consent to the data practices described in our Privacy Policy.

12. Changes to These Terms

We reserve the right to update these Terms & Conditions at any time. We will post the updated terms on this page with a revised effective date. Continued use of the platform after changes are posted constitutes acceptance of the updated terms. For material changes, we will make reasonable efforts to notify active users.

13. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law provisions. Any disputes arising under or related to these Terms shall be resolved exclusively in the state or federal courts located in Wabasha County, Minnesota. You consent to personal jurisdiction in those courts.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms shall continue in full force and effect.

15. SMS Communications Terms

15.1 Business Identity & SMS Use Cases

California Overland, Ltd. uses SMS messaging to communicate with opted-in contacts regarding driver recruitment, application status updates, scheduling confirmations, and promotional messages related to trucking career opportunities with California Overland, Ltd.

15.2 Opt-Out & Support Mechanisms

You can cancel the SMS service at any time. Just text "STOP" to (651) 927-5340. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

15.3 Message and Data Rates

As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive messages as needed throughout your application or recruiting process. Message frequency varies based on your activity. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

15.4 Carrier Liability

Carriers are not liable for delayed or undelivered messages.

15.5 Age Restriction

SMS communications are intended for individuals 18 years of age or older.

15.6 SMS Non-Sharing

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
